MOTOR VEHICLES ACT 2019

The Constitution of India has been made both rigid and flexible by the Constitution makers. This prominent feature can be evidently under Article 368. The Motor Vehicles Act 2019 is one of the major attempts in order to fulfil this spirit of the Constitution. The Motor Vehicles Act 2019 came into effect on the 1st of September, 2019. This Act made the fines and the punishments for the offenders more stringent and rigorous.

With increased urbanisation, every city has seen an immense increase in the traffic on the roads and with this increasing traffic there increases the probability of road accidents and the deaths caused due to it. This Act majorly aims at ensuring road safety, compensation for the victims of accidents, third party insurance and the health of the vehicles.

IMPORTANT FEATURES OF THE ACT:         

ROAD AND ENVIRONMENT HEALTH:

If the vehicles which are running on the roads are not fit and are causing harm to the environment and the health of others, they should be returned back to the manufacturers. The manufacturers are directed to either reimburse or replace the defective vehicle with one of the similar makes.

This Amendment vehemently propagates the increase in the penalty for traffic rule offenders. This step was taken so that the drivers become more alert while driving. This act provides more stringent actions against crimes like juvenile driving, drunken driving, overloading, over speeding and driving without a license.

NATIONAL ROAD SAFETY BOARD:

This Board was set up in order to advise the Governments of all the states in addition to the central government on matters of traffic management and road safety.

ONLINE DRIVING LICENCES:

This Act has made it possible for the issuance of a learner’s licence, mandating online identity verification. This action was taken in order to reduce the number of fake licences and improve efficiency and has also increased transparency. This Act also provides commercial licenses to be valid up to a period of five years instead of three years. There would now be driver training schools for the production of better drivers on roads.

COMPENSATION FOR THE VICTIMS OF THE ROAD ACCIDENTS:

The Act has made provisions for cashless treatment of victims of road accidents, during the golden hour. One can say that the Golden Hour is the time period up to one hour from the time of the accident. This is the time period in which the chances of survival if proper treatment is given are maximum. An effort to make this whole process cashless is also made by this Act.

COMPULSORY INSURANCE:

This Act has instructed the Government to establish Motor Vehicles Accident Fund providing compulsory insurance to all drivers of India.

Some of the major issues raised are listed below:

  • The uniform implementation of this Act all over India is a difficult task.
  • There is already an existing fund for hit and run cases, another fund created for the same purpose seems unreasonable.
  • This Act has brought stringent rules for the traffic offenders and ensures that no offenders go unpunished which would require CCTV surveillance which would, in turn, require a large investment.
  • Also, it has been noted that this amendment provides relief to victims. However, it is unclear as to which specific offences would lead to that penalty. This may make the whole attempt of providing relief futile.
  • Many states have raised the issue of curtailment of their autonomy at the behest of the central government.

BENEFITS:

  • E-Governance is one of the major highlights of this Amendment Act. With this one can acquire transport licences without any need for educational qualifications.
  • Another major benefit of this Act is that it provides increased compensation to the victims and their families and providing quick relief and insurance facilities.
  • With the discarding of the unfit vehicles, the air pollution level is expected to drop significantly.
  • With the introduction of platforms such as “Vahan” and “Sarathi”, the registration process of vehicles has been made easier and temporary registrations have been discouraged.

CONCLUSION:

The main objective of this act was to bring some major changes to the Motor Vehicles Act of 1998. Guidelines for cabs have also been released which would be finalised later. Digitalization of the services like the issuance of a licence, change in address and the issuance of the receipts has also been done. The state governments are to constantly monitor state highways, national highways, and urban roads through electronic mode. Some major amendments are also done in the compensation schemes and insurance provisions. All these have benefited the drivers of India, although some have raised their concerns over the curbing of state autonomy.
