India is a country which is well known for its rich and beautiful tradition and culture. Women have been given the place of the goddess but the past few years have seen a tremendous increase in the number of crimes against women and the security and the safety of women seems to be at a stake.

Every single day a woman, a girl, a girl child, from all aspects of life are assaulted, molested, violated, and deprived of their rights. The common crimes that take place in day to day life against women are molestation, assault by husband or relatives, rape, dowry deaths and so many more. The common places like the streets, public transports, public spaces, and office spaces have now become the place of hunters for the women in India.

Though the Constitution of India guarantees equal rights and protection to women as well these rights and laws will be of no use until and unless the mindset of the people changes against women.

WOMEN’S RIGHTS IN INDIA:

Talking about the rights of women in India, we take into account both the Constitutional as well as Legal Rights. The Constitutional Rights are those which are incorporated in the Constitution Of India while the Legal Rights are those which have been incorporated in the form of laws and acts of the Parliament and State Legislatures.

  • Article 15(1) states that there shall be no discrimination on the grounds of sex.
  • Article 15(3) states that the state can make any special provision for the empowerment of women.
  • Article 16(2) provides that there shall be no discrimination and ineligibility on the grounds of sex for employment.
  • Article 23(1) states that the trafficking of humans and forced labour should be prohibited in all forms.
  • Article 39(d) states that the state should secure equal pay for equal work for both men and women.
  • Article 39(e) provides that the state should ensure that the health and the strength of the women are not abused and that they are not forced by any economic necessity to enter workplaces that are unsuited to their health.
  • Article 42 provides that the state shall provide for just and secure conditions of work for women and also provide maternity relief.
  • Article 51-A(e) states that it is the duty of every citizen of India to renounce all the practices which are derogatory to the dignity of women.
  • Article 243-D(3) states that one- third of the total seats filled by direct election in the Panchayat should be reserved for women.

LEGAL RIGHTS FOR WOMEN:

  • Protection of women from any domestic violence under The Domestic Violence Act (2005), is a right guaranteed to women for protection from any misconduct and violence from the husband or any of his relatives.
  • Indecent Representation of Women (Prohibition) Act 1986, provides for the prohibition of any indecent representation and depiction of women in advertisements, publications, writings, paintings, etc.
  • Dowry Prohibition of Act 1961 prohibits the giving and the receiving of dowry, before or any time after the marriage from women.
  • Maternity Benefit Act 1961, entitles a woman to maternity leave and other benefits associated with it.
  • Muslim Women (Protection Rights on Divorce) Act 1986 provides for the protection of the rights of Muslim women who are divorced.
  • Medical Termination of Pregnancy Act 1971 provides for the termination of certain pregnancies by registered medical practitioners on medical and humanitarian grounds.
  • Preconception and Pre Natal Diagnostic Techniques Act 1994 (Prohibition of sex selection), prohibits the selection of sex on or after conception order prevent female foeticide.
  • The Protection of Children from Sexual Offences (POCSO) Act, 2012 was formulated to protect children from sexual abuse and sexual exploitation.
  • Hindu Succession Act 1956, recognizes the right of women to inherit any parental property equally with men. The Amendment of 2005 provides the rights to the daughters to inherit any ancestral property along with the other male relatives.

GENERAL RIGHTS EVERY WOMAN MUST KNOW:

  1. Right to free aid: 

This right guarantees that when a woman goes to a police station, not accompanied by her lawyer, she has the right to get legal aid and she should demand it.

2. Right to Privacy: 

A woman who has been raped has the right to record her statement in private in front of the magistrate without being overheard or in presence of a lady constable.

3.Right to no arrest:

A woman cannot be arrested after sunset and before sunrise as per the Supreme Court ruling. Only if the woman has committed some serious crime can she be arrested, provided there is a letter in writing by the Magistrate stating the reason for the arrest.

4.Right to Zero FIR:

A rape victim can register their police complaint from any police station under Zero FIR, as per the Supreme Court Ruling.

5.Right to Confidentiality:

Under no circumstances, can the identity of the victim be disclosed to the public or the media. As per section 228-A of the IPC, disclosing the identity of the victim to the public makes it a punishable offence.

RECENT AMENDMENTS:

The gang rape that took place on the 16th of December 2012, changed the entire legal structure of the laws governing the security and safety of women. It brought a new shape to the Criminal Act, it includes the following:

  • Section 354A provides for sexual harassment and punishment for the same.
  • Section 354B provides for assault or use of any force against women with intent to disrobe.
  • Section 354C provides for Voyeurism
  • Section 354D provides for stalking.
  • Also, the definition of Rape has been amended under section 376.

CONCLUSION:

The discrimination against women that exists will continue to exist in society till the time people change their attitude towards women and start treating them with the same rights as they treat men. Thus there is an utter need for change in the thinking and mentality of the men in society.
